Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Munchi website, mobile application and related services (the “Service”), provided by CrossDEV, Cruquiuszoom 52, 2142 EW Cruquius, the Netherlands, KvK 76028704 (“Munchi”, “we”, “us”). By creating an account, joining the waitlist, or otherwise using the Service, you agree to these Terms.

1. Eligibility

You must be at least 16 years old (or the age of digital consent in your country) to use the Service. By using it you confirm you meet this requirement.

2. The Service

Munchi provides AI-assisted meal planning, recipe recommendations and grocery lists. The Service is offered on an “as is” and “as available” basis and is currently provided in a private beta / early-access phase; features may change, be limited, or be discontinued.

3. Not medical or nutritional advice

Munchi’s meal plans, recipes, calorie and macro estimates are for general informational purposes only and are not medical, dietary or nutritional advice. They are not a substitute for advice from a qualified professional. Always check ingredients against your own allergies and medical needs. Do not rely on the Service for decisions affecting your health. You use the Service at your own risk.

4. Your account

You are responsible for keeping your login credentials confidential and for activity under your account. Provide accurate information and keep it up to date. Notify us promptly of any unauthorised use.

5. Acceptable use

You agree not to: misuse, disrupt or attempt to gain unauthorised access to the Service; reverse-engineer or scrape it except as permitted by law; upload unlawful, infringing or harmful content; or use the Service to build a competing product. We may suspend or terminate accounts that breach these Terms.

6. Subscriptions & payments

If paid plans are offered, prices, billing cycles and renewal terms will be shown before purchase. Subscriptions bought through the Apple App Store or Google Play are billed and managed by those stores under their terms, and renew automatically unless cancelled at least 24 hours before the period ends. Statutory consumer withdrawal/refund rights under EU law apply where relevant.

7. Intellectual property

The Service, including its software, design, logos and content (excluding your own content), is owned by CrossDEV or its licensors and protected by law. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your personal, non-commercial use.

8. Your content

You retain ownership of content you submit (e.g. preferences, notes, photos). You grant us a licence to host and process it solely to operate and improve the Service, as described in our Privacy Policy.

Imported content. Munchi may let you import recipes and other content from third-party websites and sources. You are solely responsible for the content you import and for how you use it. By importing, you confirm that you have the right to do so and that importing and storing the content for your personal, non-commercial use does not infringe any copyright, database right, trademark or the terms of the source. Do not import content you are not permitted to use. Munchi acts only as a neutral tool that fetches and formats content at your request; we do not review, endorse or claim ownership of imported content and are not responsible or liable for it. We may disable the import feature or remove imported content where required by law or at the reasonable request of a rights holder.

9. Third-party services

The Service may rely on or link to third parties (e.g. app stores, AI providers, hosting). We are not responsible for third-party services, which are governed by their own terms.

10. Disclaimers & limitation of liability

To the maximum extent permitted by law, the Service is provided without warranties of any kind. Nothing in these Terms excludes liability that cannot be excluded under applicable law (including liability for death or personal injury caused by negligence, or your mandatory consumer rights). Subject to that, our total liability arising out of the Service is limited to the amount you paid us in the 12 months before the claim.

11. Termination

You may stop using the Service and delete your account at any time. We may suspend or end your access if you breach these Terms or where required by law. Sections that by their nature should survive termination will do so.

12. Changes to these Terms

We may update these Terms; the “Last updated” date reflects the latest version. Material changes will be notified to you. Continued use after changes take effect means you accept them.

13. Governing law & disputes

These Terms are governed by the laws of the Netherlands, without prejudice to mandatory consumer-protection rules of your country of residence. Disputes will be submitted to the competent court of the Rechtbank Noord-Holland (location Haarlem). EU consumers may also use the European Commission’s Online Dispute Resolution platform.
